Obama-appointed Judge Grants RMGO Restraining Order Against Superior, CO Gun Control Ordinance
Blocking the Town’s Standard Capacity Magazine Ban and ‘Assault Weapons’ Ban
Denver, CO – Today, an Obama-appointed federal judge granted Rocky Mountain Gun Owners a Temporary Restraining Order against the Town of Superior’s assault weapons ban and standard-capacity magazine ban, based on the Supreme Court’s recent NYSRPA v. Bruen decision.
“This is a massive win for gun rights in the state of Colorado,” said Taylor Rhodes, Executive Director of Rocky Mountain Gun Owners.
“Today the judge affirmed what we already knew to be true – under the Second Amendment and the Bruen ruling, the Town of Superior doesn’t have a leg to stand on. Standard-capacity magazines and semi-automatic rifles are protected under the Second Amendment, and the U.S. Supreme Court has ruled that owning and carrying firearms is an individual right. Superior’s anti-gun ordinance is blatantly unconstitutional, and today the court agreed and gave us a restraining order against the Town of Superior to stop them from enforcing it.”
The order states in part: “[I]n Bruen, the Court concluded that the Second and Fourteenth Amendments protect the right of ‘ordinary, law-abiding citizens’ to ‘carry handguns publicly for self-defense.’”
The court went on to say that the Town of Superior’s gun-control ordinance “infringes on a constitutional right and therefore no further showing of irreparable harm is required. Similarly, because the public has an interest in ensuring that constitutional rights are protected, and the Town has no interest in maintaining an unconstitutional provision, the balance of Plaintiffs’ harms and the public interest weigh in favor of granting the [Temporary Restraining Order].”
“The fact that this Temporary Restraining Order was issued by an Obama appointee is huge,” said Dudley Brown, President of Rocky Mountain Gun Owners and the National Association for Gun Rights. “Outrageous gun control schemes like Superior’s cannot hold up under the Supreme Court’s Bruen ruling. We believe this spells the end of the Colorado mag ban. And to other Colorado cities with similar ordinances – you’re next.”
